Brussels turns ChatGPT into a search engine it can regulate

The European Commission has designated ChatGPT, Reddit and Roblox under the Digital Services Act, with Reddit and Roblox classified as very large online platforms and, as The Next Web and Silicon Republic both report, ChatGPT specifically as a Very Large Online Search Engine, the first time an AI chatbot has been slotted into that category. All three now have a four-month window to show they can contain systemic risks such as exposure of minors to harmful content, a clock that runs out around the January 2027 date the Commission itself has cited. It confirms what a month ago was only a Commission spokesperson's word that designation was "definitely possible": the same Digital Services Act machinery that spent the summer working through TikTok's still-open teen-account finding, Meta's addictive-design finding and Amazon's court-ordered search-algorithm fix has now reached the defining product of the AI boom.
The obligations have teeth. Silicon Republic reports the designated platforms face fines of up to six percent of global revenue if they fail to mitigate risk before the window closes, and The Next Web notes ChatGPT's search engine designation brings duties, including formal risk assessments and regulator data access, that Google and Bing have carried for years. OpenAI is not getting a quiet stretch either way: Heise Online reports it is simultaneously rolling out contextual advertising on ChatGPT's free and Go tiers, built to lean on chat context rather than user profiling so that anything more personal requires explicit consent, the GDPR-shaped compromise now standard practice for anyone serving Europe.

None of it required new legislation. The Digital Services Act was written as generic platform law; watching it absorb the sharpest product of the current AI cycle without a single amendment is the clearest evidence yet that Brussels' regulatory track, however slow it can feel, is not obsolete.

For anyone under ChatGPT's, Reddit's or Roblox's roof, the practical change lands slowly: risk assessments and mitigation plans are due to Brussels well before they visibly change what a sixteen-year-old sees, so January 2027 is the date worth watching. OpenAI's new advertising is more immediate: contextual by default, with anything closer to profiling gated behind explicit consent. Consumers uneasy with a profiling-based model in the first place already have European search options that were never built that way, Ecosia among them.

Companies building on the ChatGPT API do not inherit OpenAI's compliance duties directly, but a platform in the middle of a formal risk assessment is a platform that can change terms, rate limits or data handling with little warning over the coming months. It is also a reminder that procurement diversification is not just a sovereignty talking point. The Netherlands' newly published sovereign cloud design, open for public review, is the kind of concrete alternative a firm wary of concentration risk in a single US stack can actually evaluate, alongside existing Dutch options such as Cyso Cloud.

The Netherlands did more than react to American AI platforms today: it published a full draft design for a sovereign government cloud, structure and services laid out for public comment, a genuine step from strategy paper toward procurable infrastructure. Set against it, Agenda Digitale's reporting on the EUDI Wallet is a useful check on triumphalism. The digital identity wallet due across the EU by December 2026 promises self-sovereign identity, but its architecture still raises open questions about GDPR and eIDAS 2.0 compliance around metadata handling, proof that building European alternatives does not automatically mean building private ones. Digital sovereignty, this week's evidence suggests, is being assembled in pieces that do not yet all fit together.

Why this matters for European digital sovereignty
This designation is a good stress test of what "the regulatory track works" actually means. The Digital Services Act reaching a still-young generative AI chatbot, without new legislation and without a fresh political fight, shows the framework was built wide enough to catch products nobody had shipped when it was drafted, a genuine institutional achievement. But designation is not compliance, and the four-month runway toward January 2027 is where the DSA's record turns mixed: Amazon needed a German court order, not a Commission letter, to actually rebuild its systems, and TikTok's own preliminary findings on minors' privacy, issued in July, are still working through the process. OpenAI, unlike Amazon or TikTok, is still running Europe on the policy-only Dublin and Brussels presence this column noted earlier this week, not years of built-out local infrastructure, and it is simultaneously trying to monetise Europe through ChatGPT's new advertising layer, which gives it a real incentive to comply cleanly and fast. Set beside the Netherlands' own sovereign cloud draft and the EUDI Wallet's open privacy questions, the pattern from recent editions holds: Europe can legislate around a platform faster than it can finish building the infrastructure or identity layer underneath its own government. The rulebook is no longer the bottleneck. What still is, is everything that isn't a rule.
